Terms and Conditions
1. SCOPE OF APPLICATION & CONTRACTING PARTY
- These General Terms and Conditions apply to all contracts for the rental of apartments for lodging entered into between Alpine Held and third parties (guests), as well as to all other services and deliveries provided by Alpine Held (lodging contract).
- The Guest’s contracting party is Alpine Held GmbH, Feldhofweg 20, 6038 Gisikon, Switzerland, email: info@alpineheld.ch, hereinafter “Alpine Held.”
2. RESERVATIONS
- By making a reservation, the guest offers to enter into an accommodation contract. If the booked apartment is available, the guest will receive a reservation confirmation from Alpine Held. Upon acceptance of the reservation made by the guest, an accommodation contract is concluded between Alpine Held and the guest.
- Offers made by Alpine Held regarding available apartments are subject to change and non-binding. Alpine Held may, at its sole discretion, refuse to enter into an accommodation contract.
- The guest is entitled to the apartment specified in the booking confirmation. If, for objective reasons, it is not possible to provide that apartment, Alpine Held may offer an apartment of at least equal value at no additional cost. If this is not possible or would be unreasonable for the guest, payments made for services not rendered will be refunded. Mandatory statutory claims remain reserved.
3. CANCELLATION POLICY
- A reservation is considered guaranteed once payment has been received from the guest. A guaranteed reservation may be canceled by the guest free of charge in accordance with the stated cancellation policy, provided the reservation number is provided. Once the cancellation deadlines have passed, cancellation is no longer possible, and Alpine Held is entitled to the agreed-upon payment, less any expenses saved. The same applies in the event of a no-show. For guaranteed reservations spanning multiple days, if the guest does not arrive, all subsequent nights starting with the second night will be canceled, and the guest has no claim to the subsequent nights.
- Cancellations must be made in writing. In the event of cancellation, the guest is obligated to compensate the lodging provider for any resulting damages. The following fees apply in the event of a cancellation: From the date of the booking confirmation up to the 121st day before the start of the rental period, the guest will receive a full refund; from the 120th up to the 61st day before the start of the rental period, 20% of the total price is charged; from the 60th day up to the 31st day before the start of the rental period, 50% of the total price is charged; from the 30th day up to the 11th day before the start of the rental period, 75% of the total price is charged; from the 10th day through the 3rd day before the start of the rental period, 85% of the total price is due; if cancellation occurs less than three days before the start of the rental period, the full rental price is due. The date of receipt of your cancellation notice is decisive in each case.
- Alpine Held may terminate an accommodation contract that has already been concluded prematurely only for good cause, due to legal requirements, or in the cases specified in Section 11. If the guest is not at fault for the reason, payments already made for services not rendered will be refunded. The guest reserves the right to assert any further mandatory claims.
4. ACCOMMODATION RATES & OTHER PRICES
- The prices listed by Alpine Held at the time the contract is concluded apply. The listed prices include all mandatory price components charged by Alpine Held. Not included are local or cantonal taxes that are levied separately in accordance with applicable regulations or are owed directly by the guest, in particular visitor’s taxes. Such taxes are listed separately during the booking process, provided their amount is known at the time of booking.
- Once the contract is concluded, the confirmed price generally remains unchanged. Newly introduced or amended public charges required by law that are levied directly on the booked stay may be charged additionally, provided this is permitted by law and is clearly disclosed to the guest.
5. PAYMENT TERMS & INVOICE
- The guest must always pay the price for the entire booked accommodation service in advance.
- Accepted payment methods are MasterCard, Visa Card, and Sofortüberweisung—cash payments are not accepted.
- A stored payment method will only be charged retroactively for amounts that are due, contractually owed, and verifiably documented, and only to the extent that the charge is covered by the payment agreement or the guest’s authorization. The guest will receive a corresponding statement.
- The guest agrees that, under normal circumstances, an invoice will always be made available as a download or via email. If the guest requests delivery by mail instead, delivery times may be extended due to work-from-home arrangements and organizational reasons. Alpine Held also reserves the right to comply with requests for a company stamp or signature on the invoice for the reasons stated above.
6. TERMS OF USE FOR RESERVED APARTMENTS
- A reserved apartment is available to the guest from 3:00 p.m. on the day of arrival until 10:00 a.m. on the day of departure.
- Unless otherwise agreed, the keys and, if applicable, access cards provided must be returned to Alpine Held on the agreed departure date or placed back in the key boxes in such a way that the code is no longer readable.
- In the event of loss or failure to return a key, the guest shall bear the necessary and documented costs for replacement or reprogramming. The costs for replacing a locking system will only be charged if such replacement is necessary due to a specific security risk.
- Upon request and subject to availability, an early check-in may be arranged in advance with Alpine Held. If Alpine Held agrees to an early check-in, Alpine Held is entitled to charge 10.00 CHF per hour or portion thereof for the additional use of the apartment. There is no contractual entitlement to an early check-in.
7. RESALE
- The resale, subletting, and/or resale of booked apartments is prohibited. In particular, the resale of apartments and/or apartment quotas to third parties at prices higher than the actual apartment prices is not permitted. The assignment or sale of the claim against Alpine Held is also not permitted. In such cases, Alpine Held is entitled to cancel the reservation, particularly if, during the assignment or sale, the guest provided false information to the third party regarding the nature of the reservation or the payment.
- Use of the apartment for any purpose other than accommodation, in particular any commercial use by the guest, is expressly prohibited.
8. LIABILITY OF ALPINE HELD
- Alpine Held is liable in accordance with statutory provisions. Any prior limitation or exclusion of liability for willful misconduct or gross negligence is excluded. To the extent permitted by law, liability for slight negligence is limited to damages typical for the contract and foreseeable at the time the contract was concluded. Mandatory statutory liability provisions, in particular Articles 487–489 of the Swiss Code of Obligations (OR), remain reserved.
- Should any disruptions or defects occur in the services provided by Alpine Held, Alpine Held will endeavor to remedy the situation upon becoming aware of the issue or upon receiving an immediate complaint from the guest. The guest is obligated to do everything reasonably possible to resolve the disruption and minimize any potential damage. Furthermore, the guest is obligated to notify Alpine Held in a timely manner of the possibility of exceptionally high damages.
- Alpine Held is liable for items brought onto the premises in accordance with statutory provisions. The claim expires if the guest does not notify Alpine Held immediately upon becoming aware of the loss, destruction, or damage to the item brought onto the premises, unless this delayed notification has no impact on the investigation of the facts. Liability for items brought onto the premises is governed, where applicable, by Articles 487–489 of the Swiss Code of Obligations (OR). For valuables, large sums of money, and securities, the special provisions of Art. 488 of the Swiss Code of Obligations (OR) apply in particular. Any loss, damage, or destruction must be reported to Alpine Held immediately upon discovery.
- If an open and unguarded parking lot or parking space is made available to the guest, this does not, in principle, constitute a contract of safekeeping. Alpine Held does not provide security or safekeeping for vehicles, bicycles, or items contained therein. Alpine Held is liable for loss, theft, or damage in accordance with statutory provisions. To the extent permitted by law, liability for slight negligence is excluded. Liability for willful misconduct or gross negligence, as well as any statutory liability under Articles 487–489 of the Swiss Code of Obligations (OR), remains unaffected. Alpine Held is not liable for damages caused exclusively by other guests or other third parties, provided that Alpine Held is not at fault. Any visible damage must be reported to Alpine Held immediately.
- The statutory limitation and forfeiture periods apply to all claims.
- Alpine Held may enter the apartment to the extent necessary to avert an immediate danger, to carry out necessary maintenance or repair work, to provide agreed-upon services, or for any other objectively necessary reason. Except in cases of imminent danger, the guest will be informed in advance within a reasonable period of time, and due consideration will be given to the guest’s interests.
- Lost property will be handled in accordance with the statutory provisions on found property pursuant to Art. 720 et seq. of the Swiss Civil Code (ZGB). If the owner can be identified, they will be notified whenever possible. Shipment will be arranged upon request and at the guest’s expense; a reasonable processing fee may be charged.
- If a swimming pool, sauna, or solarium is available for use, such use is at the guest’s own risk and must comply with the rules of use and safety. Alpine Held’s statutory liability, in particular for damages caused intentionally or through gross negligence or for safety-related defects, remains unaffected.
9. SECURITY DEPOSIT
- To secure all claims by Alpine Held against the guest arising from the lodging agreement, the guest shall provide the following prior to taking possession of the apartment:
- in the case of an agreed rental period of less than three months, a security deposit in the amount of CHF 800.00,
- In the case of an agreed rental period of less than three months, the accommodation provider may pre-authorize the guest’s payment card to cover the security deposit. If the security deposit is not paid by the time the apartment is made available, the guest has no right to be provided with the apartment. If Alpine Held has nevertheless made the apartment available to the guest, Alpine Held is entitled to terminate the lodging agreement without notice if the security deposit is not paid within a reasonable grace period to be set by the lodging provider.
- Alpine Held is obligated to settle the security deposit within one month after the termination of the lodging agreement.
10. CUSTOMER DATA
- Alpine Held collects the data necessary for processing reservations, identification, and statutory guest registration. Foreign guests must provide the information required under Art. 16 AIG in conjunction with Art. 18 VZAE and present the necessary identification documents. We reserve the right to comply with any additional cantonal or municipal registration requirements. An additional identity check may be conducted for security and fraud prevention purposes; further information is provided in the Privacy Policy.
- If a guest’s identity cannot be verified beyond a doubt due to missing or incorrect documents, Alpine Held is entitled to cancel the reservation.
- Automated risk assessments may be used for fraud prevention. To the extent that this results in an automated individual decision within the meaning of Art. 21 of the Data Protection Act (DSG), the data subject will be informed accordingly and will be afforded the legally prescribed opportunities to provide input and request a review by a natural person. Details are set forth in the Privacy Policy.
11. TERMINATION OF THE ACCOMMODATION AGREEMENT
- Alpine Held is entitled to terminate the accommodation agreement for good cause. Good cause exists, in particular, if (i) force majeure or other circumstances beyond Alpine Held’s control make fulfillment of the contract impossible, (ii) apartments are booked through culpable provision of misleading or false information or concealment of material facts; material facts may include, but are not limited to, the guest’s identity, financial solvency, or purpose of stay, (iii) Alpine Held has reasonable grounds to believe that the use of the service may jeopardize the smooth operation of the business, the safety, or the public reputation of Alpine Held and its locations, without this being attributable to Alpine Held’s sphere of control or organizational authority; (iv) the purpose or reason for the stay is unlawful; or (v) in the event of resale, subletting, and/or resale by a third party (see Section 7).
- Alpine Held must immediately notify the guest of the exercise of the right of termination.
- To the extent that the early termination is based on good cause attributable to the guest, the financial consequences shall be governed by the contract and applicable law. The guest’s mandatory claims remain reserved.
12. GIFT CERTIFICATES
- A gift certificate purchased from Alpine Held can only be redeemed for services provided by Alpine Held. If there is a remaining balance after making payments with the gift certificate, that balance will carry over and can be used for future bookings. Gift certificates cannot be returned; they are non-resalable, non-transferable, and cannot be redeemed for cash. The person ordering the gift certificate is responsible for providing the correct information (especially the email address) to which the gift certificate and invoice are to be sent.
13. NO SMOKING IN THE APARTMENT
- Alpine Held Apartments are non-smoking apartments. Smoking is therefore prohibited in common areas, guest apartments, and on balconies and/or terraces. In the event of a violation, Alpine Held has the right to demand compensation from the guest in the amount of 500.00 CHF to cover the additional cleaning costs incurred, including any loss of revenue resulting from the inability to rent the apartment as a result of the violation. This compensation amount shall be set higher if Alpine Held can prove greater damages.
- Tampering with or blocking emergency exits, fire extinguishers, or the fire alarm is prohibited. Violations may result in a fee of 150 CHF.
14. NO PARTIES IN THE APARTMENT
- Hosting parties is not permitted in the Alpine Held apartments.
- To ensure that no parties are held, some apartments are equipped with a noise sensor that measures decibels. There is no audio recording; the device is active 24/7 and is located in the living area. If the noise exceeds a reasonable level, the Alpine Held team receives a notification and informs the guest. To ensure compliance with the party policy, the guest will be notified if the noise sensor is disconnected and Alpine Held needs access to the apartment to reconnect it. The noise sensors used measure only noise levels and do not record conversations or audio. To the extent that measurement data can be attributed to a specific reservation or person, it is processed in accordance with the privacy policy.
- In addition, surveillance cameras are installed at some properties outside the apartments. Guests may be visible in these recordings. Video surveillance takes place exclusively in appropriately marked outdoor or common areas and never inside the guest apartments. The purpose, data controller, recording area, retention period, and authorized access are listed in the Privacy Policy. Public property and third-party properties are generally not monitored.
- In the event of a violation, Alpine Held has the right to demand from the guest an amount of 800.00 CHF as compensation for the additional cleaning costs incurred, including any loss of revenue resulting from the inability to rent out the apartment. This compensation amount shall be set higher if Alpine Held can prove greater damages.
- For extreme cases of soiling that require the cleaning staff to work for more than 3.5 hours, a flat-rate fee of 200.00 CHF will be charged.
15. DAMAGE OR THEFT
- In the event of damage exceeding normal wear and tear or theft, Alpine Held reserves the right to bill the guest for the damage as well as any additional expenses incurred to repair the damage, including any loss of revenue resulting from the inability to rent the apartment during that time.
16. PETS
- Pets are not permitted. However, exceptions are made for guide dogs, hearing dogs, and other comparable service dogs. These may be brought along free of charge at any time upon presentation of proof. A fee of 250.00 CHF will be charged for bringing pets without permission.
17. MAINTENANCE
- The guest agrees to treat the apartment, its furnishings, and the common areas, facilities, and amenities with care and respect, and to ensure proper ventilation and heating.
- The guest further agrees to inspect the furnishings upon moving into the apartment to ensure they are complete and in good working order, and to report any complaints to the accommodation provider immediately.
- The guest is liable for all damage to the apartment provided, the furnishings, and the rooms, facilities, and equipment intended for shared use that the guest or the guest’s visitors have culpably caused through use in violation of the contract and that is not attributable to normal wear and tear. The guest must immediately report any damage to the apartment provided to Alpine Held.
- Regular cleaning during the stay will be provided only to the agreed extent and, as a general rule, upon prior notice or within an agreed time window.
18. GROUP BOOKINGS/BLOCK BOOKINGS/EVENT PERIODS
- For group bookings of more than five apartments and block-booking agreements, separate payment and cancellation terms apply, as specified in the respective contracts.
- Different cancellation deadlines apply to bookings made during events and trade shows. These are indicated during the booking process and on the booking confirmation.
19. INTERNET USE
- Alpine Held provides guests with Internet access within the limits of existing technical and operational capabilities. Disruptions, such as those due to force majeure, maintenance work, or similar circumstances, cannot be ruled out. Alpine Held assumes no liability for such disruptions.
- Internet access may not be used for unlawful purposes. In particular, actions that violate Swiss criminal law, copyright law, data protection law, or the personal rights of third parties are prohibited. The guest is liable, within the scope of statutory provisions, for damages caused by culpable unlawful use.
- The guest is prohibited from disclosing the access credentials for the Internet connection to third parties. In the event of a violation, the guest shall be liable to Alpine Held for all damages resulting from the disclosure of the access credentials.

- The privacy policy can be viewed at: https://www.alpineheld.ch/privacy-policy
22. FINAL PROVISIONS

This also applies to the cancellation of this written form requirement. Unilateral amendments or additions made by the guest are invalid.
- The place of performance and payment is the registered office of the lodging establishment.
- The statutory places of jurisdiction apply to disputes. Mandatory and partially mandatory places of jurisdiction, in particular pursuant to Articles 32–35 of the Swiss Civil Procedure Code (ZPO), as well as in international matters in accordance with the applicable provisions of international treaties and conflict-of-laws rules, are reserved.
- Swiss law applies to the extent that a choice of law is permitted by law. Mandatory provisions of Swiss and international conflict-of-laws and consumer protection law are reserved.
- Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions apply.
